KITAS

KITAS (Limited Stay Permit Card) is one of the important documents for foreigners who want to live in Indonesia. With this card, foreigners can move in Indonesia for a longer period of time. However, it is not uncommon for both the guarantor and the foreigner to wonder about the processing process.

WHAT IS KITAS?
KITAS (Limited Stay Permit Card) which was previously named KIMS or commonly known as the Temporary Settling Permit Card. KITAS is intended for foreign nationals who want to stay temporarily in Indonesia, a kind of resident permit.
According to Article 31 of Government Regulation No. 32/1994 on Visas, Entry Permits, and Immigration Permits (“Government Regulation No. 32/1994”), a Limited Stay Permit itself is one type of immigration permit granted to foreigners to stay in the territory of the Republic of Indonesia for a limited period of time.

WHO CAN APPLY FOR A KITAS?
1. Foreigner who enters the Indonesian Territory with a limited Stay Visa.
2. Foreigner who is given transfer of status from a Visit Stay Permit, such foreigner includes: (Foreigner who is given transfer of status from a Visit Stay Permit, including:)
a. Foreigner in the interest of investment (Foreigner in the interest of investment)
b. Work as an expert;
c. Carry out clergy duties.
d. Participate in education and training
e. Conduct scientific research
f. Join the husband or wife holding limited Stay Permit (Join the husband or wife holding limited Stay Permit)
g.Join the father and/or mother for a child with foreign nationality who has a family legal relationship with an Indonesian citizen father and/or mother.
h. Join father and/or mother holding the limited Stay Permit or Permanent Stay Permit for a child under 18 (eighteen) years old and unmarried (join father and/or mother holding the limited Stay Permit)
i. Foreigners who are former Indonesian citizens, and
j. Foreign elderly traveler.

3. A child that when born in the Indonesian territory his/her father and/or mother holds a limited stay permit.
4. Foreigner who is legally married to an Indonesian citizen; or
5. Child of Foreigner who is legally married with Indonesian citizen (child of Foreigner who is legally married with Indonesian citizen) 5.

TYPES OF KITAS:

1. Work Permit KITAS

The process requires additional for foreigners who take care of it. Because the work permit KITAS, can only be given to people who have received sponsorship from the company that employs them. Companies that can sponsor or bring foreign workers to Indonesia are PT, PT PMA, Representative Offices and public or private institutions. 

2. Marriage Visa KITAS

This one KITAS sponsor is none other than the wife or husband himself. Taking care of KITAS, is one of them. Especially if your partner is still in the status of getting this KITAS is one of the administrations that must be taken care of. Later foreigners will be allowed to start a family. Even though they do not hold the status of an Indonesian citizen (WNI). However, they will not be allowed to have a permanent job. 

3. KITAS Retirement Visa

Related to this KITAS is intended for foreigners who want to spend their retirement to live temporarily in Indonesia and for this type of KITAS has special requirements, namely not having a business or business that has branches in Indonesia and purely just want to retire. Aged more than 55 years. Because, that is the average age of someone taking a pension in Indonesia. This KITAS has a longer periodization than other types of KITAS.

HOW LONG DOES THE KITAS EXPIRE? 
The validity of this card is up to 2 years with the possibility of extending for another 2 years. The maximum stay in Indonesia will not exceed 6 years when using this document.
Especially for foreigners working in Indonesia, the 90-day rule also applies and can be further extended. However, the total number of residence permits in Indonesia is not more than 180 days.

There is also a KITAP (Permanent Residence Permit Card). KITAP can be obtained by foreign nationals holding KITAS who are investors, workers, elderly, and clergy. In addition, KITAS holders due to marriage can also apply for KITAP after a certain period of time.

REQUIREMENTS FOR MAKING KITAS 
The requirements for obtaining Kitas are as follows: 
1. Itas application letter from the sponsor; 
2. Letter of statement and guarantee from the sponsor (stamped Rp 10,000); 
3. ID card of the sponsor; 
4. Itas application form; Original passport and photocopy; 
5. Certificate of domicile from RT / RW or hotel or apartment; 
6. Telex approval of Itas; 
7. For Indonesian wife or husband sponsor, attach Marriage Book, sponsor’s ID card and Sponsor’s Family Card; 
8. For Indonesian parent sponsors, attach the applicant’s birth certificate with certified Indonesian or English translation; 
9. For TKA, attach IMTA, RPTKA, marriage certificate and birth certificate (marriage certificate and birth certificate must be translated into Indonesian or English by a certified translator); 
10. For Foreign Investment (PMA), attach a recommendation from the Investment Coordinating Board (BKPM) and other company documents; 
11. For students, attach a letter of recommendation from the relevant institution.
